A finance worker has been convicted of careless driving after a head-on collision on a Cumbrian road seriously injured another driver.
Eugene Nxumalo, 41, was convicted at Carlisle Crown Court of careless driving following a head-on collision on the A591 at Low Wood near Ambleside on 20 February last year. He had denied wrongdoing but was found guilty after trial. Sentencing was adjourned for a month after the judge indicated she needed more information.
Nxumalo was driving a Mercedes Benz when the collision occurred. Prosecutor Brendan Burke said the accident resulted from Nxumalo failing to correct his steering as he emerged from a corner, causing his car to drift on to the wrong side of the road. The section of carriageway was divided by two solid white lines.
The woman driving the other car suffered a spine fracture and other injuries. After leaving hospital, she depended on a Zimmer frame for mobility. She is self-employed and was able to work only half the hours she worked before the accident. The collision also retarded her recovery from a previously underlying medical condition.
Burke described the offence as 'a short episode of careless driving', but noted it had serious consequences for the injured driver. Nxumalo, of City Road in Islington, London, was represented by defence barrister Matthew Hopkins. Hopkins told the court that Nxumalo was awaiting confirmation of a permanent job as a financial officer with a company in Brussels, though the employer wished to await the outcome of the case before confirming the contract.
